FOR COMMENTS OF THE DEPARTMENT OF ENVIRONMENTAL MATTERS MINERS
observation 1
In paragraph
2.4.1, Fuel Tanks, it mentioned that in the area of mine an
additional tank will be built to the two existing in the area of
IT Pass. However, reviewing the reports approved both PCM U.
M Toquepala and update, do not include any fuel tank. In this
regard, to the respective clarification.
Answer:
Has made the
closure plan review and updating, both approved by the authority and
there is indeed a failure of said fuel tanks. About closing
costs of these facilities will be included. Appendix MEM 01
Budget Updated Project Plant Expansion Concentrator and Regrowth of
Tailings Dam Quebrada Honda, budget closing of the new facilities
and expansions Expansion Project Concentrator Toquepala and Regrowth
of Tailings Dam Quebrada is updated Sling. It is noted that the
characteristics of existing tanks are similar to the proposed
additional tank.

In Item 2.4.2,
two quarries “Ramp Pie T-16” and “La Quebrada”, projected in the EIA
approved by Decree No. 611 describes – 2014-EG / DGAAM; They
indicate that these quarries have been rejected for use during the
construction phase of the project; however, Item 5.2.4.2 and in
Table 5- 4, physical stabilization Quarries described during
progressive closure. In this respect, correct information to
clarify it.
Answer:
It states that
the two quarries “Ramp Pie T-16” and “La Quebrada”, projected in the
EIA approved by Royal Decree No. 611-2014-EG / DGAAM will be used in
the operation stage of the mining unit. It is noted that
physical stabilization measures described in Section 5.2.4.2 Closure
Plan, Physical Stabilization Canteras during the Closing
Progressive, part of the operational measures at such facilities,
hence were not considered in costs progressive closure.

Finally in
Table 5 -6, Canteras Location 5 quarries (Capilluni, Pampa La Vaca 2
Ingenio Quarry, Quarry and Quarry Golf Cimarrona), the same that
will be used for hedges ERQH indicated. The holder must
demonstrate environmental certification approved these components.
Answer:
In this regard,
the fact remains that employment authorization quarries for closure
was approved in the Plan Update Mine Closure of Toquepala Mining
Unit by RD No. No. 052-2013- MEM-AAM. It is believed desirable
that this Resolution is the environmental certification required for
such given its target for what facilities will be
used. However, if the authority finds that other environmental
management instruments are required, SPCC is committed to managing
such authorization before the final closing of the Toquepala Mining
Unit.

In Chapter 2,
it has not been provided labor for project
implementation. Answer:
The fact
remains that according to the EIA Expansion of the Toquepala
Concentrator Plant and Tailings Reservoir Regrowth of Quebrada Honda
approved with RD No. 611-2014-MEM, the project will require
approximately 2,200 direct jobs at peak construction phase and will
generate a significant number of indirect jobs in Moquegua and Tacna
regions. Annual projections of the labor force during the
construction phase in Toquepala Mining Unit can be seen in Figure
MEM 4-1 Workforce – Construction Phase.

FOR COMMENTS OF THE DIRECTOR GENERAL MINING

It presents
budgets and schedules on the new concentrator plant will have a
capacity to process 60,000 TMD sulfide copper ore, for copper
concentrates and molybdenum; and Regrowth of Tailings Dam
Quebrada Honda by regrowing Main Dam and Lateral Dike, storing the
tailings from the Toquepala and Cuajone, scoring that budgets
correspond exclusively to these two projects, not mentioned on
budgets close of the components considered in the updated Mine
closure Plan approved by Royal Decree No. No. 052-2013-
MEM-AAM. It is estimated that in the draft Regrowth of Tailings
Dam Quebrada Honda, might be considered some previously approved
components, so it requires the corresponding project, presenting a
single budget previously approved components and new components Plan
Mine closure, with prices referred the same date background
information for the determination of collateral, reference the table
below summarizes the budgets attached.

Appendix MEM 05
PCM 2013 Budget Update, the updated December 2015 closing of each of
the facilities that were approved at the Closing Plan Update budget
presented by RD 052-2013-MEM-AAM, taking consider an increase in the
budget by 12.10%, which is the average obtained discount rate
manpower, materials and equipment price indexes unified for the six
geographical areas (the location of the project is considered the
area 4 ) for the months of May 2012 and December 2015 approved by
the National Institute of Statistics and Information – INEI through
Departmental Resolution No. 150-2012-INEI and Departmental
Resolution No. 020-2016-INEI, respectively.
MEM in Table
5-1 Summary Budget Toquepala Mining Unit, you can see the updated
budget PCM 2013, the budget of the facilities Concentrator Expansion
Project and Reservoir Regrowth Tailings Quebrada Honda, and the sum
total of both budgets (excluding VAT), the same that will be
considered in the estimation of the financial guarantee for closure
of Toquepala Mining Unit.

It presents the
determination of the annual guarantees in the format of the Annex to
the Ministerial Resolution No. 262- 2012- MEM / DM 06/06/2012,
considering 37 years of life and applying the inflation rate
estimated at 1.9% and rate 2.54% discount determines the annual
guarantee US $ 860.100 in 2016, a process that is expected to apply
nonconforming rates are not excessive and life time. In this
regard it should be considered as discount rate the rate of North
American Treasuries for 10-year deposits, which for 2015 is
estimated at 2.14%. The lifetime considered 37 years is
estimated excessive to be considered as useful life for the
calculation of the guarantees, as to calculate the time remaining
useful life, it should be considered the production capacity of the
unit including the expansion of the estimated 120,000 TMD,
Concentrator specify whether the security to be determined for the
subject of this evaluation project, will be added to the guarantees
determined in the Update approved in 2013.
Answer:
In this regard
it is important to note that according to Plan Update Mine Closure
of Mining Toquepala Unit approved by the authority, the life of the
mine is for the period 2011 – 2052. Since the implementation of
financial guarantees for this Amendment will run in 2017, the
remaining lifetime is 36 years, which will be considered in the
calculation of the financial guarantee.
On the other
hand, for the calculation of the financial guarantee will be taken
into account the total amounts for closing Mining Toquepala Unit:
updated amounts of PCM approved in 2013 and amounts of the Expansion
Project Concentrator and Regrowth Reservoir Tailings Quebrada Honda
(see observation MEM 05); also it is considered discount rate
rate Treasury Bonds North America for deposits to 10 years, which
for 2015 was estimated at 2.14%.
With the
considerations set forth in the preceding paragraphs and taking into
account the amount of financial security provided by SPCC so far it
is US $ 8’467,301; MEM is presented in Table 6-1 Calculation of
Financial Guarantees, where the first amount of collateral to
consider in 2017 will amount to US $ 2’544,271, including IGV.
